I'm aware of the problem. We all had hoped that the Big Daddy update that ended in April would take care of these issues but it didn't in many cases. For more on Google's Big Daddy update, please visit this link.

GoogleBot doesn't make the decision on spam would be my guess. It just records the info and delivers it per se. I know google has made major changes to their site and I also believe they have adjusted their variables as I believe, and I may be mistaken, alt and title attributes do not have the weight they once did in search engine optimization. At the very least they don't show as highlighted keywords when viewing my cache in google.
